According to clarification of DOP&T , as communicated by Defence Accounts Department /CGDA, total 300 days Leave encashment is allowed as per CCS Leave Rules. However applicability of CCS Rules is restricted to the civil services only. So, Ex serviceman group must submit an appeal to consider only civil service for leave encashment. Leave encashed in defence services are not comes under CCS leave rules.
If an ex serviceman appointed in a government dept under re-employee category (like commissioned officers), duly considered his previous seniority, work experience, designation/rank and Pay, then previous service encashment will be include in total 300 days as per CCS(Leave) rule 39(6)(a)(jii). Moreover, JCOs/OR are discharged, not retired. The commissioned officers are only retired on superannuation.
If an ex serviceman appointed in a government sector by facing competitive exam at par with the fresher recruit and appointed as a newly recruit, his service experience, seniority, rank and pay is not considered at all , he fall under CCS(Leave) rule 38 (A) and 39(2)(a) and previous encashment will not include in new service.
रक्षा लेखा विभाग/सीजीडीए द्वारा सूचित डीओपीएंडटी के स्पष्टीकरण के अनुसार, सीसीएस अवकाश नियमों के अनुसार कुल 300 दिनों की छुट्टी नकदीकरण की अनुमति है। हालाँकि सीसीएस नियमों की प्रयोज्यता केवल सिविल सेवाओं तक ही सीमित है। इसलिए, पूर्व सैनिक समूह को अवकाश नकदीकरण के लिए केवल सिविल सेवा पर विचार करने के लिए एक अपील प्रस्तुत करनी होगी। रक्षा सेवाओं में भुनाया गया अवकाश सीसीएस अवकाश नियमों के अंतर्गत नहीं आता है। इसके अलावा, जेसीओ/ओआर को सेवामुक्त किया जाता है, सेवानिवृत्त नहीं। कमीशन प्राप्त अधिकारी केवल सेवानिवृत्ति पर सेवानिवृत्त होते हैं।
यदि किसी पूर्व सैनिक को पुनः कर्मचारी श्रेणी के तहत सरकारी विभाग में नियुक्त किया जाता है, उसकी पिछली वरिष्ठता, कार्य अनुभव, पदनाम/रैंक और वेतन पर विधिवत विचार किया जाता है, तो पिछली सेवा नकदीकरण सीसीएस (छुट्टी) नियम 39 के अनुसार कुल 300 दिनों में शामिल किया जाएगा। 6)(ए)(जीआई).
यदि किसी पूर्व सैनिक को नई भर्ती के बराबर प्रतिस्पर्धी परीक्षा का सामना करके सरकारी क्षेत्र में नियुक्त किया जाता है और नई भर्ती के रूप में नियुक्त किया जाता है, तो उसके सेवा अनुभव, वरिष्ठता, रैंक और वेतन पर बिल्कुल भी विचार नहीं किया जाता है, वह सीसीएस (छुट्टी) नियम 38 (ए) और 39(2)(ए) के अंतर्गत आता है। और पिछला Leave Encashment नई सेवा में शामिल नहीं होगा।
