Entitlement of Pension Admissible to NoK on Death of the Exserviceman 

After death of Ex-serviceman, following pension and other welfare grants are admissible :-

When an officer/JCOs/OR  dies due to natural causes neither attributable to nor aggravated by mil service, the NoK is entitled to OFP.  This is applicable to serving Offrs/JCOs/OR and for retired Offrs/JCOs/OR also.  Types of OFP are as under :-

(a)  Enhanced Rate of OFP   @ 50% of the last drawn RE for a period of seven years from date of death or till the ESM would have attained the age of 67 years had he been alive, whichever is earlier.

(b) Normal Rate of OFP. @ 30% of the last drawn RE for life, on termination of the period of Enhanced Rate of Ordinary Family Pension.

Para 8 of Entitlement Rules 2008 (Revised 2021) stipulates that in case an officer /JCO /OR  who has been granted Disability Pension / War Injury Pension dies within seven years on account of same cause for which Disability / War Injury Pension was granted to him at the time of release, the NoK is entitled to Special/Liberalized Family Pension. In such a scenario, the widow shall have to stake her claim for Special / Liberalized Family Pension to AG’s Branch (AG/MP-5(b)/MPRS (O) for Offrs &  Concerned Record Offoce for JCOIs/OR  who in turn shall take up the case with AG/PS-4(Imp-I) for sanction of award.

General. The NoK of an officer/pensioner is entitled to OFP in the event of Serving officer/JCOs/OR pensioner reported missing. The family must lodge an FIR about the missing officer. The Family Pension shall be admissible with effect from the date of missing of the officer/pensioner but shall be released six month from the date of lodging of FIR. 

The eligible family member shall have to furnish copy of the FIR and Non-traceable certificate from the police. 

The pensioner shall be taken as missing/presumed dead from the date of lodging of FIR. The family member shall also have to furnish an indemnity bond declaring that the entitlement released to them shall be refunded to the Govt in case the pensioner is found at a later date.
