Honourable Supreme Court of India on 9th Jan 2023 has ordered on OROP case and Appeal for extension of date of payment of arrears and revision of pension as pw OROP Module to all eligible pensioners of the Indian Army, Navy and Air Force has been granted to the Union Govt upto 15 March 2023. Earlier also the Appex Court granted such extension and now the second time such extension allowed to the Union government.

Chief Justice DY Chandrachud and Justice PS Narasimha comprises the Bench of judges asked the Union Govt to ensure that arrears on account of OROP are paid expeditiously without any further delay. Supreme Court also granted liberty to the ex-servicemen association to file an application if they were aggrieved by any action of the Govt with regards to the payment of arrears of OROP.

So, it may be assumed that the orders dated 4 Jan 2023 regarding payment of arrears in four six monthly installment may be modified and reconsidered to implement the court order.

In March 2022, the Supreme Court had called for the payment of arrears following a Court case filed by the IESM, Indian Ex-servicemen Movement against the Centre’s activity. All tabulations to fix the pension of armed forces retirees as per modalities of OROP scheme had been completed as stated by Attorney General R Venkataramani , appeared for the Centre told the court that. He also ensured that the details have now been sent to the Ministry of Defence for final approval.

On 23^rd December, a press release was published by the Union Govt as they had approved a revision of pension of ex-servicemen under OROP with retrospective effect from July 1, 2019.

OROP Revsion is effective for around 25 lakh pensioners. According to the Defence Ministry, the decision will to an additional. Officials said that an additional expenditure of ₹8,450 crore will be made to implement the court order. More over, ₹23,638 crore will be paid as arrears to the pensioners from July 2019 to June 2022.

As per modalities of OROP, pension of the past pensioners would be re-fixed on the basis of the average of minimum and maximum pension of defence forces retirees of the calendar year 2018 in the same rank with the same length of service. However, pension for those drawing above the average shall be protected. The benefit would also be extended to family pensioners, including war widows and disabled pensioners.
