15th September 2022 is now over. OROP was ought to be implemented by 15th September 2022 as per Orders of Hon’ble Supreme Court of India but they have failed to obey the order. Even after strict order of the Apex Court of India, veterans soldiers are still deprived out of their legitimate rights. It might have been ignored by the Pension Sanctioning authority of our country but the Veterans ESM Associations are still active and trying to convince the authority to implement the OROP second revision as it is due since July 2019 as stated by the veterans.
“OROP is now a day dream” it is a mouth word of exservicemen fraternity. Upto some extent it may be true as per the disappointment experienced by the veterans. Actually the reality is something different from it. Some are saying that, Modi Govt will award OROP-2 just before the Central Election of 2024. The Government authority on a written communication with the Exservicemen Association has expressed that implementation of One Rank One Pension (OROP) has been done vide MoD letter no. 12(1)/2014/D(Pen/Pol)- Part-II dated 07.11.2015 and tables for fixation of pension were issued vide MoD letter no. 12(1)/2014/D(Pen/Policy)-Part-II dated 03.02.2016. This was the First time revision under OROP Scheme. The 2nd Revision after 5 Years was due in July 2019.
The MoD has also expressed that the Hon’ble Supreme Court vide its order dated 16.03.2022 directed that in terms of the communication dated 7th November 2015, a re-fixation exercise shall be carried out from 1st July 2019, upon the expiry of five years. Accordingly the Govt authority has confirmed that “Revision of pension under OROP with effect from 01.07.2019 is under process”.
It has been cleared that till date no indication of OROP revision has been found at any level by the Ex-servicemen Organisation neither any table of fixation published by the Govt till date even after expiry of cutoff date as fixed by the Hon’ble Supreme Court of India. What the next ? Legal Notice has been served by Exservicemen organisation to the MoD on 12th August to implement the orders of Supreme Court. Several Veterans Organisation have approached all the Chief of Staffs and Defence Pension authority but the Govt authority has not responded. Even after passing the stipulated period, the Govt authority has not responded till date. The Exservicemen Organisation has twitted that if the Govt failed to implement the OROP revision as per direction of Hon’ble Supreme Court, a Contempt of Court case may be filed against the MoD.
