OROP 2 is the Legitimate Right of Armed Forces Pensioners
It is well known to all that the OROP case has been finalized by the Supreme court and Armed Forces pensioners are waiting eagerly for getting their pension revised from 01.07.2019. The time allowed by the apex Court to the Govt has already crossed. Till date neither any OROP Fixation Table has been published nor any notification in this regard has been published by DESW or PCDA. It is true thatt the OROP 2 is the Legitimate Right of Armed Forces Pensioners. To break the ice in this govt bureaucracy, a legal notice has been issued to the Govt of India, DESW on 12th August 2022 by the IESM, the exservicemen organisation fighting for the rights.

Legal Notice Served by IESM to Secy DESW and other Govt Authority
The matter of the Legal Notice served through the Petitioner’s advocate is reproduced here for awareness of the readers.
“Under the instructions received from and on behalf of my client, Indian ExServicemen Movement, represented by Gp Capt VK Gandhi, we serve you with this notice.
Through the order dated 16.03.2022, in the above captioned matter, the Hon’ble Supreme Court of India directed that in terms of the communication dated 07.1 1.2015, a re-fixation exercise shall be carried out from 01.07.2019, upon the expiry of five years. Arrears payable to all eligible pensioners of the armed forces shall be computed and paid over accordingly within a period of three months. The three months period prescribed in the aforesaid order lapsed on 15.06.2022, however, you have not complied with the order/direction passed by the Hon ‘ble Supreme Court till date.
ln view of the above, I call upon you to comply with the order dated 16.03.2022 passed by the Hon’ble Supreme Court within 15 days of receipt of this notice; otherwise we will take steps towards initiation of contempt proceedings against you.” Issued by Advocate Balaji Srinivasan
Review Pettion to Supreme Court and Follow up action by Govt Authority
In this regard it may be referred here that the Review Petition was filed at the Hon’ble Supreme Court on 18.04.2022 on the OROP case for listing on 26 th July 2022 to review the order dated 16 th March 2022. It is well known to all Army, Navy and Air Force Pensioners that after a long waiting the Apex court had delivered the Final Verdict on the Case of OROP on 16thMarch 2022. Case Title: Indian Ex Servicemen Movement (An All India Federation Of Military Veterans Organization Represented Vs. Union Of India Department of Ex-servicemen Welfare Ministry Of Defence Secretary| Writ Petition (Civil) 419/2016.
Meanwhile, the Govt authority had approached the Apex Court to allow three months more time for calculation of formula for Revision of pension under OROP scheme which is due since July 2019.
