It was general concept that in the event of receipt of any kind of pension, the former soldiers /officers treated as exserviceman. Basically JCOs/OR after completion of 15 years of service in case of service pension. For offrs in similar case, the the minimum pensionable service is 20 Years.
For disability pensioners, there is no minimum service length required. Recently Govt of India has published notification regarding grant of exserviceman status to Short Service Commissioned Officers.

CLARIFICATION ON ISSUE OF ESM IDENTITY CARD
1. Further to this Sectt letter even reference dated 06 Sep 2022.
2. Following amendment may please be carried out in ibid letter :-
For Para 2 (c) Short Service Commissioned Officers (SSCOs) who have not completed initial terms of service are being considered for issue of ESM (0) I-Cards. All SSCOs who have completed initial term of engagement with gratuity will be given ESM status / issue of ESM I-Card wef 13 Feb 2020. However, all such individuals who exited before 13 Feb 2020 will not be eligible for ESM benefit.
Read Para 2(c) ESM status has been granted to all those Short Service Commissioned Officers (SSCOs) who were released after completion of their initial term of engagement and have been released other than by way of dismissal or discharged on account of misconduct or inefficiency and have been given gratuity. However, these officers would be entitled for the ESM benefits wef DOPT Notification dated 13 Feb 2020.
