सेना और सिविल पेंशनभोगियों के लिए केंद्र सरकार के पेंशन नियमों में बदलाव क्या है जाने
पेंशन के लिए अधिक लाभ की सुविधा और पेंशन भुगतान प्रक्रिया को आसान बनाने के लिए पेंशन के नियम लगातार बदलते रहे हैं। इस तरह के बदलाव को सरकार द्वारा हाल ही में अधिसूचित किया गया है जिससे Civil और Military सभी प्रकार के पेंशनभोगी लाभान्वित हो सकते हैं। इस लेख में हम पेंशन नियमों में इस बदलाव के बारे में जानेंगे।
रक्षा मंत्रालय, भूतपूर्व सैनिक कल्याण विभाग (DESW) ने 05.01.2022 को पेंशन और पेंशनभोगी कल्याण विभाग (DOP & PW) के दिनांक 16.06.2021 के कार्यालय ज्ञापन के आधार पर इस तरह के बदलाव को अधिसूचित किया है।
वर्तमान मामले में पेंशन में पूर्व में क्या प्रावधान था ?
केंद्र सरकार के पेंशनभोगियों की पेंशन के मौजूदा नियमों के अनुसार, Civil और सैन्य पेंशनभोगियों दोनों के लिए और सेना के लिए पेंशन विनियमों के Regulation 75, भाग I, 2008, इन नियमों के तहत अगर परिवार के योग्य सदस्य सेवारत कर्मियों की हत्या के अपराध के लिए या इस तरह के अपराध के लिए उकसाने के लिए आरोपित है तो उन्हें और परिबार के बाकि किसी भी योग्य सदस्यों को तब तक फॅमिली पेंशन नहीं मिलेगा जब तक उसके खिलाफ शुरू की गई आपराधिक कार्यवाही के समापन न हो अर्थात उनका सामान्य पारिवारिक पेंशन (Ordinary Family Pension) प्राप्त करने का क्लेम तब तक के लिए निलंबित रहेगा। आपराधिक मामले के फैसले तक दावेदार को किसी तरह की फॅमिली पेंशन नहीं दिया जायेगा।
सेना और सिविल पेंशनभोगियों के लिए केंद्र सरकार के पेंशन नियमों में आया यह बदलाव
DOP&PW पत्र दिनांक 16.06.2021 के अनुसार और रक्षा पेंशनभोगियों के लिए रक्षा मंत्रालय, DESW पत्र दिनांक 05.01.2022 के तहत, सरकारी कर्मचारी की हत्या का अपराध या ऐसा अपराध करने के लिए उकसाने के लिए आरोपित है तो ऐसे स्थिति में पीड़ित के परिवार के अन्य योग्य सदस्य के लिए पारिवारिक पेंशन स्वीकार्य है।
तो, यह स्पष्ट है कि ऐसे परिवार के अन्य योग्य सदस्य को पेंशन मिलेगी और आपराधिक मामले के फैसले तक प्रतीक्षा करने की आवश्यकता नहीं है।
यह प्रावधान सशस्त्र बलों के कर्मियों पर सिविल पेंशनभोगियों के लिए लागू होने वाली प्रभावी तिथि यानी 16.06.2021 से लागू है।
इस आदेश से आपको क्या लाभ मिलेगा ?
किसी भी सरकारी कर्मचारी के परिवार के सदस्यों के साथ ऐसी घटनाओं के कारण उत्पन्न होने पर परिवार के सदस्यों को ऐसी स्थिति में आर्थिक तंगी का सामना नहीं करना पड़ेगा।
